TERMS OF USE OF THE MY PET STORY APPLICATION BY BUSINESS CUSTOMERS AND NON-PROFIT ORGANIZATIONS

  1. Dictionary
    1.1. Publisher – MY PET STORY LIMITED LIABILITY COMPANY with its registered office in Poland in Zamość (registered office and address for delivery: ul. Jasna 9, 22-400 Zamość); entered into the National Court Register under the KRS number: 0000746613; the court in which the company’s documentation is kept: Lublin-East District Court in Lublin with its registered office in Świdnik, VI Economic Department of the National Court Register, entry in the register: August 29, 2018; share capital: 5,000.00 PLN; Tax Identification Number (NIP): 9223059029; National Business Registry Number (REGON): 3811245 and email address contact@mypetstoryapp.com.
    1.2. B2B Platform – means the websites under which the publisher operates the B2B Platform, which is a part of the MyPetStory Mobile Application, operating under the domain mypetstory.pl.
    1.3. Mobile Application – the MyPetStory application operated by the Publisher for download on Android and iOS systems, available in the Google Play and AppStore.
    1.4. Business Customer – an individual, legal person, or organizational unit without legal personality conducting business activities in the zoological industry on commercial terms, who registers on the B2B Platform. Business Customers may include entrepreneurs running pet shops, zoological wholesalers, manufacturers in the zoological industry, distributors in the zoological industry, grooming establishments, veterinary clinics, and animal hotels, among other service providers.
    1.5. Non-Profit Organization – a legal person or organizational unit without legal personality conducting business activities in the zoological industry on non-commercial terms, which registers on the B2B Platform. Non-Profit Customers may include animal shelters and foundations working for animals with a registered KRS number.
    1.6. User – an individual who has been granted specific rights to use the B2B Platform by a Business Customer or Non-Profit Customer.
    1.7. Customer – the collective term for the Business Customer and Non-Profit Organization.
    1.8. Branch – any retail or service point of the Business Customer registered on the B2B Platform (e.g., in the case of a network of pet stores, each store belonging to that network).
    1.9. Regulations – mean these regulations, defining the rights and obligations of the Publisher, Customers, and Users.
    1.10. Account – individual access to the B2B Platform and the Mobile Application granted to the Customer by the Publisher under the terms specified in the Regulations, for the purpose of their use of the B2B Platform and the Mobile Application.
    1.11. Subscription – the paid right to use services in the B2B Platform and Mobile Application for a given Branch within the scope of the selected subscription package.
    1.12. Subscription Period – a 30-day settlement period applicable regardless of each registered Branch.
    1.13. Promotional Period – the period during which a Business Customer has the right to use the functionality of the Mobile Application after registering without incurring a fee.
    1.14. Payment Date – a calendar day each month on which the Business Customer is obliged to pay the Subscription in accordance with the received invoice.
  2. Type of services provided by the Publisher
    2.1. The Publisher provides electronic services that consist of providing the Mobile Application and the B2B Platform on the Internet, through which the Business Customer can carry out marketing activities aimed at increasing competitiveness and improving communication with customers. Within the panel for stores and producers, Business Customers will be able to: • register their store, company, add a location, • organize promotions in B2C or B2B channels in the form of coupons using personalization according to the Subscription available for a given type of Business Customer • use the knowledge base for the zoological industry regarding animal care • build a network of loyal customers around their store • invite employees, partners, and customers to the B2B Platform and the Mobile Application.
    2.2. The Publisher provides electronic services that consist of providing the Mobile Application and the B2B Platform on the Internet, through which the Non-Profit Organization can promote adoptions and events using coupons targeted to application users, and manage a team of volunteers.
    2.3. The Customer may invite Users to use the B2B Platform to whom they grant specific rights. The Customer is fully responsible for the actions and consequences of the actions invited by the Users. A User invited to use the B2B Platform by the Customer is obliged to accept these Regulations.
  3. General provisions
    3.1. The Mobile Application, along with the B2B Platform available at the website mypetstory.pl, is operated by the Publisher.
    3.2. These Regulations are addressed to Customers using the Mobile Application and the B2B Platform.
    3.3. The Publisher reserves the right to edit and change these Regulations.
    3.4. The Publisher may refuse to provide the service to anyone without giving a reason.
    3.5. By registering in the Mobile Application, the Customer declares that they are authorized to provide the necessary data for the Account registration.
    3.6. The Publisher does not verify the personal or company data provided by the Business Customer and is not responsible for the consequences of providing untrue or outdated data. In the event of credible information by the Publisher that the data provided during the registration process is untrue or violates the rights of third parties, the Publisher has the right to refuse to create or block the Customer’s Account.
    3.7. The Customer uses the Mobile Application and the B2B Platform at their own risk.
    3.8. The Publisher reserves the right to delete the Account of a Customer who violates the regulations or applicable law.
    3.9. The Publisher is not responsible for any lost benefits caused by the use of the Mobile Application and the B2B Platform.
    3.10. The total liability of the Publisher is limited to the amount paid to the Publisher by the entity that incurred the damage.
    3.11. The Publisher is only liable for actual damages caused solely by its fault.
    3.12. Technical support and assistance from the MyPetStory Team are provided only for Non-Profit Organizations and Business Customers who have paid the subscription for the current period and for Business Customers in the Promotional Period.
    3.13. The Customer declares that they will not copy, duplicate, or use any materials found on the pages in the domain www.mypetstoryapp.com or in the resources of the Mobile Application and the B2B Platform without the written consent of the Publisher or other entities. The Customer may use the aforementioned materials only to the extent of permissible use.
    3.14. The Customer is obliged to use the B2B Platform and the Mobile Application in a manner that is not burdensome for other users, with respect for the personal rights of third parties and all rights accruing to them. Violation of these principles may result in the immediate deletion of the Customer’s Account.
    3.15. All materials that the Customer shares on their Account in the Mobile Application and on the B2B Platform remain their property. The Publisher may disable their Account at any time at the Customer’s request, resulting in the deletion of all their content.
    3.16. By adding additional materials (photos, product descriptions, events, etc.) to their Account in the Mobile Application or the B2B Platform, the Customer declares that they are the owner of the rights to these materials and that they do not violate the rights of third parties.
  4. Privacy policy and personal data processing
    4.1. The rules for the protection and processing of personal data are described in the Privacy Policy. The Privacy Policy is an integral part of these Regulations. The Privacy Policy is available at: [insert link to the Privacy Policy].
    4.2. By accepting the Regulations, the Customer agrees to the processing of their personal data in accordance with the Privacy Policy.
  5. Subscription and payment
    5.1. The Subscription is settled for a 30-day period from the day of its activation, irrespective of the date of registration.
    5.2. The Subscription fee is payable in advance and depends on the selected package. The fee is specified on the website and in the Mobile Application at the time of activation of the Subscription.
    5.3. The Payment Date for each period is set individually for each Customer.
    5.4. The Subscription fee can be paid by a traditional bank transfer to the bank account specified by the Publisher or by using the electronic payment methods available in the Mobile Application.
    5.5. In the event of delay in payment, the Publisher has the right to block access to the Account and the functionality of the B2B Platform and the Mobile Application.
    5.6. The Customer has the right to resign from the Subscription at any time, with the proviso that the Subscription fee is non-refundable for the period in which the Customer resigns.
    5.7. The Publisher has the right to terminate the provision of services and delete the Customer’s Account in the event of a material breach of the Regulations by the Customer.
    5.8. The Publisher is not responsible for any costs, damages, or lost benefits incurred by the Customer due to the blocking of access to the Account and the functionality of the B2B Platform and the Mobile Application as a result of late or no payment.
  6. Final provisions
    6.1. These Regulations come into force on the day of publication on the Publisher’s website.
    6.2. These Regulations have been made available to the Customer free of charge in a manner enabling them to obtain, reproduce, and record the content of the Regulations. 6.3. The Customer can obtain the content of the Regulations by printing it from the Publisher’s website or downloading it from the Mobile Application.
    6.4. The Customer has the right to submit complaints regarding the services provided under these Regulations. Complaints should be submitted in writing to the Publisher’s address or by electronic means to the email address provided in point 1.1.
    6.5. The Publisher undertakes to consider each complaint within 14 days of its receipt and to inform the Customer about the method of its consideration.
    6.6. The Customer has the right to terminate the Account and the Subscription in the B2B Platform and the Mobile Application at any time by sending a request to the Publisher.
    6.7. Any disputes arising from the implementation of these Regulations will be resolved by the competent common court.
    6.8. Matters not covered by these Regulations are subject to the provisions of generally applicable law, in particular, the Civil Code and the Act on Providing Services by Electronic Means.
  7. Amendments to the Regulations
    7.1. The Publisher reserves the right to amend these Regulations for important reasons, in particular, to adapt them to the applicable legal provisions.
    7.2. Amendments to the Regulations will become effective within 7 days of the date of publication of the new content of the Regulations on the Publisher’s website.
    7.3. Customers will be informed about the changes in the Regulations by means of a message sent to the email address provided during registration.
    7.4. If the Customer does not accept the new content of the Regulations, they should terminate the Account and the Subscription within 14 days from the date of notification of the change in the Regulations.
    7.5. Failure to terminate the Account and the Subscription within the time limit specified in point 7.4 is tantamount to acceptance of the new content of the Regulations.
